Barbara Kraml

Born 1983 in Steyr/Austria, studied Political Science and Law and received her degrees from the University of Vienna in 2007 (Magistra philosophiae) and 2011 (Magistra iuris). Her academic interest focuses on legal and political gender studies and the Austrian political system. In her diploma thesis on Gender Budgeting she analysed a pilot project concerning Gender Budgeting in the Viennese district Meidling. From 2007 to 2010 she worked as a teaching assistant at the Department of Penal Law and Criminology at the University of Vienna. Additionally she did an internship at the Federal Criminal Court in Vienna in June 2007. In the winter semester 2012/2013 she spends a research stay at the Birkbeck School of Law, University of London.


Sex, Power and Penal Law. An analysis of the political debates concerning amendments to Austrian Sexual Penal Law in the course of the last four decades (working title)

If we consider that law should enable and protect autonomy, the development of Austrian Sexual Penal Law seems quite inconsistently in the course of the last four decades. On the one hand, Austrian Parliament acted progressively and fully penalised sexual violence quite early. On the other hand, it showed opposing, conservative tendencies in regard to the decriminalisation of homosexual acts. To explain why these inconsistencies could arise one has to analyse the debates in the run-up to amendments to Sexual Penal Law. According to a constructivist point of view knowledge claimed as “true” within these processes influenced whether a certain social (sexual) norm was transformed into a legal one or not. Therefore the processes of social construction of knowledge within Parliamentary debates are going to be examined to show not only the produced text, but also the underlying structures of text production.
